FAMILY- BASED IMMIGRATION

In today’s world, navigating the complicated, confusing and often dangerous process of obtaining permanent residence status in the United States requires experienced and skilled legal representation. You cannot and should not do it alone. Now, more than ever before, the various ways to obtain permanent residence, citizenship and asylum in the United States are undergoing constant restriction, change and revision. To protect all of your rights and liberties, and to properly analyze your eligibility for the immigration benefits that you are seeking, you need a highly experienced and skilled attorney to guide you and your family through the process.

Your immigration requirements may include:

  • Family-Based Immigrant Visa Petitions for the spouse, children, parents and siblings of U.S. citizens and Legal Permanent Residents, including Adjustment of Status in the United States (I-130 & I-485) and Consular Processing of Immigrant Visas abroad.

  • Removal of Conditions on Permanent Residence where the initial two year grant of Conditional Permanent Residence has expired or is about to expire. (I-751)

  • Preparation of Hardship Waivers in support of Immigrant Visas Petitions (I601A & I-212)

  • Petitions for the Battered or Abused Spouse of a U.S. Citizen or Legal Permanent Resident pursuant to the Violence Against Women Act - VAWA (I-360)

  • Renewal of Permanent Residence Cards (I-90) and Employment Authorization (I-765)

  • Travel Documents - Advanced Parole (I-131)

  • Deferred Action for Childhood Arrivals - DACA (I-821D)

citizenship & Naturalization

For most people, applying for citizenship is usually a smooth and uneventful process. For others, however, applying for citizenship can be fraught with uncertainty and surprise. While most people meet the basic residency requirements and English language proficiency to qualify for citizenship in the USA, there may be personal circumstances such as arrests, criminal convictions, tax problems, developmental and health issues, or extended period of time spent outside the USA which could effect a person’s ability to have their application approved AND in some cases, subject them to removal proceedings and/or deportation. It is essential that an experienced immigration attorney thoroughly evaluate your eligibility for naturalization before you apply. The Law Office of Bradley D. Shaw will give you the confidence you need to proceed with your citizenship application.

immigRation court & removal proceedings

Removal proceedings before the U.S. Immigration Court are at an all time high and likely to grow. An experienced immigration attorney familiar with the most current forms, case law, agency decisions and legal requirements is essential and can make the difference between remaining in the United States or being sent back to a country you hardly know.

If you are an undocumented immigrant, have lived in the USA more than 10 years, have children who are US Citizens, and have had no encounters with the criminal justice system, you may qualify for an application called “Cancellation of Removal” (EOIR 42A & 42B) or other relief
